KUCHING: A fruit seller was sentenced to 12 months in jail by the Magistrate’s Court here today, for injuring two men with an axe while fishing at the Kampung Bintangor Jetty, Jalan Datuk Ajibah Abol last Tuesday (July 12).

Accused Harris, 45, pleaded guilty to two charges read out by an interpreter before Magistrate Syarifah Fatimah Azura Wan Ali.

According to the two charges, he was charged with intentionally inflicting injuries on the victims, Abang Mohd Sofean, 26, and Mohd Faizul, 33, using a weapon that could kill, namely an axe.

He committed the act at a jetty in Kampung Bintangor, Jalan Datuk Ajibah Abol, here around 5.30 pm on July 12.

He was charged with the offence under Section 324 of the Penal Code which provides for imprisonment of up to ten years or a fine or whipping or both, if convicted.

For the first charge, the accused was sentenced to 10 months’ jail while for the second charge he was sentenced to 12 months in prison.

The court ordered the accused to start serving the jail term starting from the date of arrest on July 13.

According to the facts of the case, the complainant and three other friends were fishing at the jetty when they were suddenly approached by a man with an axe in his hand.

The accused suddenly wanted to cut the complainant but managed to dodge and hit the back of the complainant’s shoulder and there were scratch marks.

Meanwhile, the complainant’s friend was cut on the head that caused injuries, thus requiring five stitches.

The complainant then lodged a police report for further action. This led to the arrest of the accused on July 13.

It is understood that while the complainant and his friends were fishing, an unknown man holding an axe came and asked them where his girlfriend was now.

The complainant only replied that he did not know where the accused’s girlfriend was. Angered by the answer, the accused then acted aggressively to go amok by slashing the complainant and his friends.

Prosecuting Officer Inspector Mohd Adzmei Ahmad requested that the accused be given a heavy sentence as a lesson.
