KUCHING: A 40-year-old farmer who pleaded guilty to committing incest and rape of his minor stepdaughter was on Monday (Dec 7) sentenced to 20 years’ jail and will get 18 strokes of the cane.
He was charged with two counts of committing the rape and incest of his stepdaughter since she was in Form One until she got pregnant out of wedlock.
The accused was charged with both offences under Section 376B (1) of the Penal Code which carries a sentence not exceeding 20 years’ jail and whipping.
Special Court judge for sexual crimes against children, Jason Juga, in delivering the sentences ordered the punishment to begin immediately.
The judge also ordered the accused, who hails from Bau, to undergo rehabilitation and counselling while serving his jail sentence.
For the first offence, the accused was sentenced to 20 years’ jail and nine strokes of the cane, while for the second offence he was also sentenced to 20 years’ jail and nine strokes of the cane.
According to the facts of the case, at 12.57pm on Nov 24, the victim lodged a police report at the Bau Police Station claiming that she had been raped by her stepfather since she was in Form One.
The accused has been married to the complainant’s mother since Aug 11, 2006 and from that day the complainant moved out of their house to live with her grandfather in Kampung Bogag, Bau until she was 13 years old.
The complainant moved back to live with her mother and stepfather after that. That was when the dark episode in her life started.
