KUCHING: The Sessions Court here today sentenced a former Indonesian cook to one year imprisonment for overstaying in the country, where his Temporary Working Visit Pass (PLKS) had expired more than five years ago.
The accused Deden Muhammad Padilah, 22, pleaded guilty to the charge which was read out by an interpreter before Judge Maris Agan.
According to the charge, he was charged under Section 15 (1)(c) of the Immigration Act 1959/63 and punishable under Section 15(4) of the same act for not having valid permission documents to be in Sarawak, Malaysia, after his PLKS expires on Aug 9, 2017.
The accused was arrested in a rented room on the first floor, above a grocery store in Jalan Satok, at about 3.50pm on Feb 16.
The court ruled that the accused should serve his jail term starting yesterday.
According to the facts of the case, acting on information, a police team raided a rented room above a shophouse and managed to detain the accused as he was identified as a wanted suspect.
In addition, the 22-year-old Indonesian also faced another charge under Section 376(2) of the Penal Code for raping a 29-year-old local woman.
However, he pleaded not guilty after the charge was read out before Judge Jason Juga.
According to the charge, he was charged with committing the accursed act in his rented room, at about 6am on Feb 12.
It is understood that the accused and the victim are lovers, who both work at a leading restaurant.
Deputy public prosecutors Md Syafique Md Hilme and Tan Chuan Yi prosecuted the case while the accused was not represented by a lawyer.
