KUCHING: Batu Lintang assemblyman Batu Lintang assemblyman See Chee How is ready for any legal action from Parti Sarawak Bersatu (PSB) President Datuk Seri Wong Soon Koh.

“If the party decides to take any legal action, we are ready to look into it,” he said.

According to Article 17 (7) of the Constitution of the State of Sarawak, he said, an elected representative has to give an undertaking in writing to the Sarawak Legislative Assembly (DUN) Speaker and not to the political party. Besides, it has to be done voluntarily.

“I don’t know if the contract we signed (before the state election) was given to the DUN speaker or not. Secondly, if we look at the contract, many claimed that it was not so voluntary,” he told the reporters during a press conference today.

“How can you give a watikah (appointment) letter to someone and later require them to sign those agreements,” he said.

However, he said, he would not comment further on the matter again as advised by his lawyer.

See was responding to Wong’s statement, urging the former to honour the terms of his agreement with PSB and vacate his Batu Lintang state legislative assembly seat immediately after he decided to quit the party.

The PSB President said See signed a contract that required him to quit from the state assembly if he chose to resign from the party having won the seat under the PSB ticket.

Article 17 (7) stated that any person who has voluntarily given an undertaking to the Speaker in writing that he will not resign his membership from the political party for which he stood or to which he belonged when he is elected to the Dewan Undangan Negeri, shall, if he resigns from the political party after being elected, be disqualified in the interest of public integrity and morality from continuing to be a member of the Dewan Undangan Negeri with effect from the date he resigned from the political party.

On Sunday, DUN Speaker Tan Sri Asfia Awang Nasa announced that See had resigned from the party and wished to remain as Batu Lintang State Assemblyman as an Independent in the state assembly.

The three-term assemblyman won the Batu Lintang seat in the 12th Sarawak state elections last December in a five-cornered contest against Sih Hua Tong (GPS), Cherishe Ng (PKR), Voon Lee Shan (PBK) and Alex Leong (Aspirasi).

He had joined PSB together with Ba Kelalan assemblyman Baru Bian in May 2020, one month after being sacked from PKR.
