SIBU: The Sessions Court today fined a woman RM6,000, in default six months’ jail on two counts of violating the Control of Drugs and Cosmetics Regulations 1984.
Judge Marutin Pagan convicted Juliana, 26, of the offence and fined her RM3,000 in default three months’ jail for each charge.
According to the first charge, she was accused of selling two bottles of ‘Thai Slim Power Look 10’s’ which is not a registered product to customer Cannilia Kerine at a premises in Jalan Salim, here between 8.25am and 10am on Jan 19.
The second charge stated that she was found to have possessed 31 bottles of the same product at a premises on the same day.
Both charges were framed under Regulations 30(1) of the Control of Drugs and Cosmetics Regulations 1984 and punishable under Section 12(1) of the Sale of Drugs Act 1952 which carries a fine of up to RM25,000 or three years’ imprisonment or both upon conviction.
The Court was told that on Jan 19 at about 8.25am, a pharmacy enforcement officer, the complainant from the Sarawak Health Department, instructed Cannilia to conduct a test purchase by contacting a seller.
Two bottles of ‘Thai Slim Power Look 10’s’ were bought and payment was done via online transfer for a total of RM110 to the seller’s (accused) bank account.
The seller then instructed Cannilia to collect it from a premises at Jalan Salim. At about 10.8am, the complainant together with his team went to the premises.
Upon inspection, the products were believed to be unregistered, and were promptly confiscated.
It was confirmed that the seized products were not registered with the Drug Control Authority.
Juliana pleaded for leniency and opted to pay the fine.
