Man jailed three years for smuggling migrant

KUCHING: A local man was sentenced to three years in prison by the High Court here today after being found guilty of smuggling an Indonesian migrant into the country through the fenced area of ​​the Immigration, Customs, Quarantine and Security (ICQS) Complex in Biawak, Lundu, three years ago.

Judge Dr Alwi Abdul Wahab sentenced Addy Rezamry Rosadi, 26, while giving a decision at the end of the defence case.

In handing down the sentence, Alwi said Addy chose to remain silent when called to defend himself on a charge under Section 26A of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act (ATIPSOM) 2007.

Based on the evidence presented, Alwi found that the prosecution succeeded in proving the case against the accused on all charges beyond reasonable doubt.

Therefore, the accused was found guilty of the charges brought against him.

According to the charges, he was accused of smuggling in a 28-year-old Indonesian migrant man from a distance of 100 metres from the fence of the ICQS Biawak, Lundu, at about 12 pm on June 13 in 2020.

It is understood that during the incident, a team of soldiers from the 4th Regiment Royal Armoured Corps (4 KAD) had carried out Ops Serkap in a rats’ trail (lorong tikus) and arrested a local man (accused) plus an Indonesian man.

Investigation found that the accused was harbouring the Indonesian citizens into the country.

The investigation of the case was conducted by Senior Deputy Assistant Director of the Malaysia Immigration Department Mohamad Fuad Topek.

Deputy Public Prosecutor Mason Jaro Lenya Barayan prosecuted the case while the accused was represented by two lawyers namely Francis Teron and Timotius Ngau Wan.
