KUCHING: The Magistrate’s Court here ordered a 19-year-old youth to be sent to Henry Gurney School until he turns 21 on six counts of outraging the modesty of women and trespassing into the home of an elderly man.
The school is a centre established in 1949 under Malaysian Juvenile Court.to care for young offenders.
The vegetable gardener was sent to the school immediately following a social report hearing before three separate Magistrates.
He was first charged under Section 447 of the Penal Code for trespassing into the house of a 73-year-old man at Taman Kong Tiong, Jalan Stephen Yong around 10.30 pm on Dec 6, 2022.
As for the second to fifth charges, he was charged with outraging the modesty of four women aged between 20 and 35 by showing them his private parts in four separate incidents at the victims’ residences around Padawan on Dec 6, 2022, as well as on Mar 24 and Apr 1 this year.
For all four counts, he was charged under Section 509 of the Penal Code, which carries up to five years in jail or a fine or both, if convicted.
Meanwhile, for the sixth charge, he was charged under Section 354 of the Penal Code for using criminal force with intent to outrage the modesty of a foreign woman at the stairs of a building in MJC Batu Kawa around 7.30 pm on Apr 8.
According to the facts of the case, in all the incidents, the youth followed his female victims who were alone to quiet places before flashing his private parts and asking them to have sex with him.
In addition, he would break into the victims’ houses or be in front of the fences of the houses before committing the acts.
Five police reports made by the victims led to the arrest of the youth.
The prosecution was handled separately by three prosecuting officers, namely, Insp Mohd Adzmei Ahmad, Insp Merylene Lindan Andrew Mang and Insp Nur Syafiqa Nyaie Ilin.
