SIBU: A 27-year-old woman was today fined RM1,000, in default of one month’s jail by the Sessions Court here for violating the Poison Act 1952.
Sessions Court Judge Marutin Pagan imposed the fine on Tang Ya Ung after she did not contest the charge against her.
He also instructed that the seizure of drugs as exhibit to be forfeited and return to prosecution for disposal.
According to the charge sheet, the accused was found to have sold by retail a Group B Poison as a dispensed medicine, to wit, one strip labelled “YSP Prednisolone 5mg” with 10 white tablets containing Prednisolone, a poison which is listed in the first schedule of the Poison Act 1952 to Lian Minggu Dana without a prescription from a registered medical practitioner.
The offence which took place at a pharmacy outlet in Jalan Salim here at about 3.03 pm on Jan 19 last year, comes under Section 13(b) of the Poison Act 1952, punishable under Section 32(2) of the same Act.
The Act provides for a fine up to RM3,000 or an imprisonment term up to one year or both upon conviction.
And in the case of any conviction, any drug to which the conviction relates and any similar drug found on the accused’s premises or in his/her possession at the time of the commission of the offence shall be forfeited and be disposed of in such manner as the director general of Health may direct in accordance with Section 32(5) of the Poisons Act 1952.
Tang who pleaded for leniency, paid the fine.
