KUCHING: An unemployed man was fined RM2,500 in default of three months in jail by the Magistrate’s Court here yesterday for using violence against a police officer with the rank of corporal who was on security patrol at Jalan Pustaka last February.
Iskandar Roslan, 38, pleaded guilty to one charge under Section 353 of the Penal Code, which was read before Magistrate Syarifah Fatimah Azura Wan Ali.
Upon conviction, he can be sentenced to imprisonment for up to two years, a fine, or both.
He was accused of committing the offence at Jalan Pustaka at around 11.55 am on February 27.
According to the facts of the case, the victim, along with a fellow officer, was on a security patrol around Jalan Pustaka when they encountered a man riding a motorcycle without wearing a helmet.
The victim directed the accused to stop by the side of the road for inspection as many as four times.
However, the accused refused to comply with the instructions and provocatively slowed down the motorcycle in front of the police vehicle.
The victim stopped by the roadside and got out of the vehicle but noticed the accused making a U-turn towards the victim and the fellow officer.
Moreover, the accused attempted to hit the victim but the victim managed to dodge the attack.
Not only that, but the accused also struck and punched the victim twice, leading to a scuffle between them.
As a result of the incident, the victim suffered injuries to the left eyebrow area.
The accused was subsequently arrested for further action.
The prosecution was conducted by Inspector Prosecutor Nur Syafiqa Nyaie Ilin, while the accused was unrepresented by a lawyer.
