KUCHING: An elderly citizen was ordered to maintain peace for six months by the Magistrate’s Court here today for failing to comply with an agreement to provide maintenance to a woman with disabilities (OKU) who gave birth to their son.

Tan Soon Lin, 60, pleaded guilty to the charge under Section 67 of the Criminal Procedure Code (CPC) read before Magistrate Zubaidah Sharkawi.

According to the facts of the case, the complainant, who is the mother of the victim, filed a police report along with an agreement stating that the accused failed to comply with the Letter of Agreement to provide maintenance to the victim and their son.

Previously, the accused admitted to causing the victim, who worked as a general worker in a company, to become pregnant after having sexual relations around early February this year in a store room.

Furthermore, the accused stated that he would take responsibility for the victim’s pregnancy and agreed to sign a Letter of Agreement to provide maintenance to the victim from the end of February or early March.

However, after sealing the agreement, the accused showed no cooperation to comply with it and frequently cited a lack of funds, requesting postponements until the end of June 2023.

Subsequently, the accused gradually paid an amount of RM6,750 to the victim until the birth of the baby on November 2.

Their son, born on November 2, was then handed over to the complainant’s foster family without the accused’s knowledge on November 3.

The prosecution was conducted by prosecuting officer Inspector Nur Shafiqa Nyaie Ilin, while the accused was not represented by a counsel.
