KUCHING: “The reason I recorded an obscene video of my wife was to use it against her if she did something behind my back,” confessed a man before being sentenced to a RM4,000 fine, in default seven months in prison, by the Magistrates’ Court.
Bong, 48, a mechanic, also uploaded the obscene video of his wife to his Facebook account, which caught the attention of many social media users.
Magistrate Ling Hui Chuan sentenced the accused after he pleaded guilty to charges under Section 292 of the Penal Code.
According to the charge sheet, he was accused of possessing obscene videos on a Vivo Y15S mobile phone at a rented house in Kampung Tapah, Jalan Kuching-Serian, around 3.25pm on May 16.
If convicted, he could face up to three months in prison or a fine or both.
Based on the facts of the case, on April 4 at around 6pm, the complainant (his wife), an Indonesian national, was in her rented room when her friend showed her that her husband had uploaded a video of her in the bathroom on his Facebook account.
The bathroom video showed the complainant wearing only underwear.
Later, on May 13 at around 8pm, the complainant was again informed by her friend through a WhatsApp picture message about a semi-nude image of her, which her friend captured from the accused’s Facebook account.
The spread of the images and videos left the complainant feeling embarrassed, traumatised, and scared. The act also humiliated her, prompting her to file a police report for further action.
She suspected that her husband still had many more inappropriate photos and videos of her.
The accused was arrested by the police at a house in Kampung Tapah around 3.25pm on May 16.
The investigation revealed that all of the victim’s nude videos were found in the accused’s phone gallery, and checks on the Facebook account where the video was shared confirmed it was registered under the accused’s name.
The case was prosecuted by Inspector Nurshafiqa Nyaie Ilin while the accused was not represented by a lawyer.
