Man jailed for retaining stolen motorcycle

KUCHING: The Magistrate’s Court here sentenced a local man to six months in prison for retaining a stolen motorcycle belonging to another man last Sunday.

Richard Embun, 26, from Sembayang, Sri Aman pleaded guilty before Magistrate Ling Hui Chuan to a charge under Section 411 of the Penal Code, which provides for imprisonment of up to five years and a fine, upon conviction.

He was charged with keeping and possessing a stolen Yamaha motorcycle belonging to a 26-year-old man by the roadside in Kampung Tabuan Melayu, at around 7 pm.

Based on the case facts, at around 6 am on Oct 10, the complainant found his motorcycle parked in Jalan Daya, Taman Riverview, had gone missing and suspect that it was stolen.

A police report was lodged for further action and investigation.

On Oct 20, the police arrested Richard as he was acting suspicious with a Yamaha motorcycle that did not have front and rear license plates.

Checks on the vehicle’s engine chassis number, found that it was a motorcycle that was reported missing.

Further investigation revealed that Richard had kept and possessed stolen property, based on the engine chassis number and identification by the complainant.

Insp Nur Shafiqa Nyaie Ilin prosecuted the case while Richard was unrepresented by counsel.
