LAND perimeter surveys under Section 6 of the Sarawak Land Code are not an attempt by the state government to claim native customary rights (NCR) land.
This was clarified by Datuk Dr Juanda Jaya (GPS – Jemoreng) in response to Krian assemblyman Ali Biju’s (PH – Krian) allegation during the debate on the National 2020 Budget.
“Ali Biju has been saying that if the state government does the perimeter survey under Section 6 of the Sarawak Land Code, the land can be taken back by the government,” Juanda told a press conference yesterday.
He described this as a ‘malicious claim’, and said Ali should check with the Land and Survey Department and the state government.
“If his allegation is correct, show the proof. Give a list of cases,” Juanda challenged, emphasising that there had been no record whatsoever to support Ali’s claim.
He said Ali was manipulating the kampung folk.
“The state government’s efforts in conducting perimeter surveys under Section 6 is to mark the land first to settle individual areas via Section 18,” he explained.
“There are bound to be disputes, so this is done to avoid encroachments,” Juanda said.
Meanwhile, Miro Simuh (GPS – Serembu) said it was possible to go directly to Section 18 of the Sarawak Land Code without first going through Section 6 if the land was not disputed and if there were no other land boundaries with other land such as state land.
“Demarcations have to be done between the state land and the NCR land,” he said.
