KUCHING: A local man was sentenced to six months in prison and fined RM3,000 by the Magistrate’s Court today for attempting to rob an eatery worker with a spear.

Mohd Nizamuddin Sajiman, 30, pleaded guilty to the charge under Section 393 of the Penal Code, read together with Section 34 of the same Code, before Magistrate Zubaidah Sharkawi.

According to the charge, he and an accomplice, who is still at large, attempted to rob a teenage boy at an eatery on Jalan Semarak at around 4.54 am on June 25.

If convicted, he could be sentenced to a maximum seven years in prison and subjected to caning or a fine.

Zubaidah ordered the accused to serve an additional three months in prison if he fails to pay the fine.

Facts of the case revealed that based on the investigation, the complainant was working when approached by two men armed with a spear, and one of them entered the eatery.

When the complainant tried to approach them, the accused and his accomplice fled on a motorcycle.

However, during the escape, the accused fell off the motorcycle after the complainant rammed the back of the motorcycle in a chase.

The accused’s accomplice managed to escape, but the accused was detained by the complainant along with the spear and helmet used in the robbery.

A police report was lodged by the complainant, leading to the arrest of the accused in the emergency ward of a hospital on the same day.

The prosecution was conducted by prosecuting officer ASP Arman Ibrahim, while the accused was not represented by a counsel
