KUCHING: A bistro manager was charged in the Magistrate’s Court here on three counts of defrauding a businessman in relation to obtaining five foreign workers’ permits, causing the victim to lose RM20,950.
Kenny, 39, from Jambusan, pleaded not guilty to three charges under Section 420 of the Penal Code which were read before Magistrate Manson Jaro Lenya Barayan today.
Upon conviction, he is liable to be sentenced to imprisonment of not less than one year and not more than 10 years and caning and can be fined.
According to all the charges, Kenny was accused of defrauding a 33-year-old man by promising to get a foreign worker’s permit and passport and asking him for a sum of money as a deposit.
The victim then made payments to him in stages amounting to RM10,000 on August 2 last year and RM1,350 on August 10 last year at a bank in Jalan Khoo Hun Yeang here.
On September 2022 at a cafe in Jalan Rubber here, the victim himself handed over a sum of RM9,600 to Kenny for the same matter.
However, until now the victim has not received any permit or passport as promised. Feeling cheated, the victim came forward to file a police report for further action.
Because of this, the court set a date for the case management to be mentioned again on August 30.
Meanwhile, Kenny was released on cash bail amounting to RM3,500 with a local surety.
The prosecution of the case was handled by Prosecuting Officer Inspector Merylene Lindan Andrew Mang while the accused was not represented by a lawyer.
