KUCHING: A businessman has been sentenced to two days in jail and fined RM2,000 by the Magistrates’ Court after head-butting and biting his wife during an argument in a car.
The charges, under Sections 323 and 326A of the Penal Code, were read before Magistrate Zaiton Anuar on Thursday (June 8), to which Kuan, 52, pleaded guilty.
The first charge accused Kuan of intentionally causing pain to his 51-year-old wife in a compact car in front of a private nursery building in Jalan Pisang at about 8.30am on May 28.
The second charge stated that he committed the same offence in front of their house in Jalan Kapor at around 8.40am on the same day.
Magistrate Zaiton handed down a sentence of one day imprisonment and a fine of RM1,000 or two months imprisonment for each charge.
According to the facts presented in court, the incident occurred during an argument between the couple in the car, triggered by Kuan’s alleged communication with another woman on social media. Although Kuan admitted to contacting the woman, he denied any infidelity.
In a fit of rage, Kuan struck his wife’s head against the car seat belt three times and bit her right hand. He also caused damage to the front of the car by hitting a pile of wood in front of their house.
When the victim requested the car keys after getting out of the vehicle, Kuan pushed her, causing her to fall and sustain scratches on her left leg and swelling on her right knee.
The victim filed a police report, leading to Kuan’s arrest a day after the incident. The prosecution was conducted by prosecuting officer Inspector Mohd Adzmei Ahmad while the accused did not have legal representation.
