Companies found guilty of damaging fiber optic cable network

SIMANGGANG: Two companies were fined RM100,000 and RM40,000 in default of not more than two months’ imprisonment for causing damage to a 48-core underground fiber optic cable network around Sri Aman five years ago.

Judge Muhamad Yasser Mohd Nasri on Wednesday (Jan 19) meted out the sentence after representatives from both companies pleaded guilty to seven charges read out at the Sri Aman Sessions Court.

The companies, Naim Gamuda JV Sdn Bhd and Endaya TRC PK JV Sdn Bhd, were found guilty under Section 235 of the Communications and Multimedia Act 1998.

According to the facts of the case, the first accused, Naim Gamuda JV, was found to have committed five offences causing damage to the fiber optic cable network starting from the Bukit Temudok Telekom Malaysia (TM) Station towards the Bukit Begunan TM Station.

Meanwhile, Endaya TRC PK JV was found to have committed two (same) offences in Engkilili TM Station heading to Spaoh TM Station.

Malaysian Communications and Multimedia Commission (MCMC) officer Mai Zairani Zainal Abidin prosecuted the case while the two companies were represented by Timoty Lim and Kenny Lau of David Allan Sagah & Teng Advocates.

The lawyers asked the court to commute the sentence throughout the trial process.
