SIBU: A woman heaved a sigh of relief when she was acquitted and discharged of two charges involving dangerous drugs by the High Court here yesterday.
Justice Datuk Christopher Chin Soo Yin made the ruling at the end of the prosecution’s case without calling Sia Sin Ling, 35, to enter her defence.
He pointed out a prima facie case had not been established beyond reasonable doubt by the prosecution against her.
Sia has earlier claimed trial to the first charge of trafficking in dangerous drug, to wit, 754.19 grams of methamphetamine, at the roadside behind the building of the Sibu Post Office, at about 1 pm on May 17, 2021.
The offence is listed under Subsection 39B(1)(A) of the Dangerous Drugs Act 1952 and punishable under subsection 39B(2) of the same Act which provides the death penalty or imprisonment for life, upon conviction.
Sia claimed trial to the second charge of having in her possession 1755.75 grams of ketamine at the same place and time, an offence under Subsection 12(2) of the Dangerous Drugs Act 1952 and punishable under subsection 12(3) of the same Act which carries a jail term of up to five years or fine up to RM100,000 or both if convicted.
A total of seven prosecution witnesses were called to testify in the trial. Sia was represented by counsel Rosli Gapor.
