KUCHING: The Magistrate’s Court here fined a local man, RM900 or two weeks in prison in default, for trespassing into an elderly couple’s house while intoxicated last Sunday.
Elexton Tony Peter, 26, pleaded guilty before Magistrate Mason Jaro Lenya Barayan to a charge under Section 448 of the Penal Code.
He committed the offense in Bandar Baru Samariang, Jalan Sultan Tengah, at 2.30 am on January 28.
According to the case facts, the wife of the 60-year-old homeowner reported a loud knocking on their locked main door.
Believed to be intoxicated, Elexton forcibly entered by breaking the knob.
The complainant promptly lodged a police report, leading to his arrest at 2.45 am the same day.
Despite the intruder’s inebriated state, no items were lost from the house.
Elexton, who was soaking wet and reeked of drains and alcohol, had broken into the victim’s house, sat down, and requested the complainant to contact the police.
Prior to the incident, he had been drinking heavily and had no recollection of the events.
Insp Merylene Lindan Andrew Mang prosecuted the case, while Elexton was unrepresented by counsel.
