KUCHING: An unemployed man was sentenced to eight years in prison and ordered to be given two strokes of the rotan for raping his underage girlfriend.
Sessions Court Judge Maris Agan meted out the sentence on Carlos Vebelee Tomy after he pleaded guilty under Section 376(1) of the Penal Code today.
The 23-year-old from Taiping, Perak, admitted to having sexual intercourse with the victim, who was then 13 years and eight months old, between 12.30am and 9am on May 26 at an unnumbered house in Kampung Simpok.
Based on the facts of the case, the complainant (victim’s father), had lodged a police report that his daughter had come out of their house in Kampung Gayu with an unknown man on a motorcycle.
When the victim returned home the next day, the complainant had asked several questions and the victim admitted to having sexual intercourse with the accused at his house in Kampung Simpok.
In mitigation, the accused regretted committing the offence and promised not to repeat similar acts in the future.
