SIBU: A 22 -year -old man was sentenced to eight years’ imprisonment plus three lashes of the whip by the Sessions Court in Kapit on Tuesday (June 21) for causing grievous bodily harm to a woman.
The accused, Daniel Sugai, from Rumah Sugai, Sungai Song, who is a labourer, pleaded guilty under Section 326 of the Penal Code before Judge Marutin Pagan.
According to the facts of the case, the accused broke into the quarters of Christina Senaie Bada, 30, from the front door and hid in the toilet at about 2.15pm on May 27 at Sekolah Kebangsaan (SK) Nanga Selibut, Song.
Then when he opened the bedroom door, he saw the victim was asleep and he later went to the kitchen and picked up a knife.
After that he lay down next to the victim and started molesting her until the victim woke up and screamed for help.
With a knife in his hand, the accused attacked her causing her to suffer from injuries.
A police report was lodged by the victim’s husband and the accused was arrested at about 7.30pm on the same day at the school.
Meanwhile, Daniel also faces two other charges under Sections 442 and 354 of the Penal Code in relation to the case.
Sibu Subordinate Court Assistant Registrar Romme Ahmad Zaidi on June 8 allowed the accused bail of RM3,000 each for the two charges.
He also ordered the accused to appear in the Kapit Magistrate’s Court on June 27 for case mention.
In the first charge under Section 442 of the Penal Code, Daniel was charged with trespassing that provides for imprisonment for up to three years or a fine of up to RM5,000 or both upon conviction.
In the second charge, he was charged with molesting the victim at the same time and place under Section 354 of the Penal Code.
He faces up to 10 years in prison or a fine or whipping upon conviction.
