Elderly molester fined RM8,000

SIBU: An elderly man, who tried to outrage the modesty of a woman, was today (Sept 6) fined RM8,000, in default eight months’ jail by the Sessions Court here.

Chieng Huo Ai, 61, from Miri, pleaded guilty to the charge read and explained to him through an interpreter before Sessions Court Judge Musyiri Peet.

The charge against him mentioned that he had assaulted the 36-year-old victim with intent to outrage her modesty by touching her private parts at a house in Jalan Lim Han Swee on June 14, 2022 at about 7 am.

Thereby, he had committed an offence punishable under Section 354 of the Penal Code, which carried an imprisonment term of up to 10 years or fine or whipping or any two of such punishments.

According to the facts of the case, on June 14, 2022 at about 7.30 am, at a house in Jalan Lim Han Swee, the complainant was viewing the CCTV (Closed Circuit Television) footage of the device installed at the living room.

Based on the CCTV footage, she saw her sister-in-law, who was a disabled person, had been sexually assaulted by her brother-in-law.

She found the accused took off the shorts worn by the victim and inserted his fingers into the victim’s private parts.  

The accused then unzipped his pants and moved his body closer to the victim.

Acting on the report received, a police team led by Insp Hairul Husin subsequently arrested the accused at Jalan Kampung Nyabor on the same day.

The victim is a 36-year-old disabled person with learning disability problem, incapable of making decisions on her own as well as has difficulty to speak.

Based on the investigation, the victim communicated that the accused took off her pants and inserted his fingers into her private parts, and the victim made a gesture indicating the accused had invited her to “play”.

From the medical examination, the victim suffered from an old hymenal tear.

DPP David Bakit Nuing appeared for the prosecution while the accused who was represented by legal counsel, Jacob Wong, opted to pay the fine.
