KUCHING: Petra Jaya MP Datuk Seri Fadillah Yusof doubts proper consultation had taken place on the relocation of the Sabah and Sarawak High Court Registry from Kuching to Kota Kinabalu.
Fadillah said he was shocked when he first learned of the decision by the federal government.
“I’m not sure whether this is a Cabinet decision or not,” he commented.
“I’m not sure whether proper consultation was done, which I doubt it happened, but whatever it is, Article 121(4) of the constitution needs to be complied with.”
Fadillah cited Article 121(4) which reads, “In determining where the principal registry of the High Court in Sabah and Sarawak is to be, the Yang di-Pertuan Agong shall act on advice of the Prime Minister, who shall consult the Chief Ministers of the States of Sabah and Sarawak and the Chief Judge of the High Court.”
He said the federal government would be disrespecting Sarawak if the constitution was not complied with.
