KUCHING: A foreigner was sentenced to 15 years’ imprisonment and 15 strokes of the cane by the Sessions Court for rape and sexual assault.
The accused Mus, 40, from Sangat Raas, Indonesia raped and sexually assaulted a friend’s 14-year-old disabled daughter.
As for the first charge, he was charged with raping an underage girl under Section 376 (2) of the Penal Code.
The offence carries an imprisonment term of between 10 and 30 years as well as whipping upon conviction.
For the first charge, the accused was sentenced to 15 years’ jail and 10 strokes of the canes. As for the second charge, the accused was charged with sexually harassing and assaulting the victim, and as such faced charges under Section 14(a) of the Child Sexual Offences Act 2017 which carries a jail term of maximum 20 years and canning if convicted.
Musli was sentenced to eight years’ jail, five strokes of the whip for the second charge.
Both offences were committed at a house in Kampung Suba Buan at around 3pm on October 4.
The court has ruled that the accused to serve jail terms concurrently.
Based on the facts of the case, the victim is the youngest daughter of the complainant who holds a disabled persons card while the accused is a friend of the complainant.
The complainant made a police report for further investigations and police arrested the accused on October 7.
The prosecution of the case was handled by Deputy Public Prosecutor Norshafatihah Nor Azmi while the accused was not represented by any counsel.
