KUCHING: A local gadget supplier company was fined RM32,000 by the Sessions Court here for selling 199 counterfeit ‘Apple’ brand smartphone accessories.
The accused, Aiman, 26, owner of the company, pleaded guilty to a charge read before Judge Iris Awen Jon.
According to the charge, the company was accused of supplying counterfeit goods such as Airpod Pro (46 units), 71 units of Airpods Pro (Magsafe Charging Safe), 20W USB-C power adapters (16 units), Lightning to USB cables (25 units), USB power adapters (29 units), and Apple batteries (12 units).
The company committed the offence at a premises in Metrocity Matang, at around 10.45 am on July 5, 2023.
Therefore, the company was charged under Subsection 102(1)(b) of the Trade Marks Act 2019 and punishable under Subsection 102(1)(ii) of the same Act.
Upon conviction, they could be fined not exceeding RM10,000 for each item with a registered trademark used falsely or face an imprisonment term not exceeding three years or both.
Based on the facts of the case, on July 5, 2023, at around 10.45 am, a team of officers from the Domestic Trade and Cost of Living Ministry (KPDN) Kuching Branch, together with representatives of the Apple trademark, Messrs Leong & Associates, conducted an inspection at a premises in Metrocity Matang.
The inspection found 199 units of counterfeit smartphone accessories bearing the ‘Apple’ brand.
All items were seized, and further examination by the brand representatives confirmed that all seized items were counterfeit.
Investigations revealed that the company had committed an offence by selling or offering counterfeit goods bearing the ‘Apple’ brand.
Deputy Public Prosecutor Nor Azhari Yusof handled the prosecution while the accused was not represented by a counsel.
