Habitual drug offence earns man five years

SIBU: A 38-year-old man was sentenced to five years’ imprisonment by the Sessions Court here today for repeatedly abusing drugs.
Judge Marutin Pagan also ordered Fayrafik Hayrery Taha from Kampung Hilir, Kuala Matu, to get a lash of the cane as penalty.
Fayrafik had earlier pleaded guilty to taking amphetamine and methamphetamine, an offence under Section 15(1)(a) of Dangerous Drug Act 1952 (Act 234).
Since he has had no less than two previous convictions for the same offence, his latest crime was punishable under Section 39(1) of the same Act.
Section 39(1) of the Dangerous Drug Act 1952 provides for a jail term of between five and seven years and liable to whipping of not more than three strokes, upon conviction.
In outlining the facts of case, Deputy Public Prosecutor David Bakit Nuing told the court that at about 1 pm on Oct 10, 2022, police conducted a narcotic raid behind the building of The Freshmart Supermarket, Jalan Hua Kiew and arrested Fayrafik on suspicion of involvement in drug activities.
Fayrafik who pleaded for leniency was not represented by counsel.
