KUCHING: An Indonesian woman was fined RM10,000 and sentenced to three months in jail for entering Malaysia without a valid travel permit and being involved in operating gambling machines in a café last month.
Felecia Santiani, 23, from Singkawang pleaded guilty before Sessions Court Judge Maris Agan yesterday to a charge framed under Section 6(1)(c) of the Immigration Act 1959/63 and read together with Section 6(3) of the same Act.
According to the charges, she was allegedly in the country illegally during her arrest at a café at Jalan Tabuan Jaya at around 12.30 am on May 29.
If convicted, Felecia may be fined up to RM10,000 or sentenced to jail for a term of up to five years or both and may be subjected to a maximum of six lashes of the cane.
For this offence, Maris sentenced the convicted to a fine of RM10,000 in default of four months in jail.
Maris also ordered Felecia to be handed over to the Immigration Department after serving her sentence or paying the fine.
Meanwhile, in the Magistrate’s Court, the convicted was also sentenced to three months in jail for being involved in operating an online gambling machine with a Poco smartphone.
For the offence, she was charged under Section 4B(a) of the Common Gaming Houses Act 1953, which carries a fine up to RM100,000 for each gambling machine and can be sentenced to jail for a term of up to five years.
Magistrate Syarifah Fatimah Azura Wan Ali ordered Felecia to serve her sentence effective from the date of her arrest on May 29.
DPP Mohammad Fauzan Zamri and Insp Mohd Adzmei Ahmad prosecuted the cases while, the accused was unrepresented by a counsel.
The case was investigated by Investigating Officer SM Kipli Jeman.
