KUCHING: An unemployed man was fined RM3,000 by the Magistrates’ Court here on Thursday (April 28) for damaging a hut belonging to a businessman, causing a loss of RM5,000.
Rabzi Saini, 33, pleaded guilty to the charge read before magistrate Zaiton Anuar. The accused is looking at six months in jail if he fails to pay the fine.
According to the charge, he intentionally caused damaged to a property belonging to Kusmatdie, 43, at Jalan Tanah Perkuburan Kampung Buntal here on April 2.
The accused was charged under Section 427 of the Penal Code, which provides for imprisonment of not less than one year and not exceeding five years or a fine or both.
According to the facts of the case, the complainant was informed by his neighbour that his hut had been vandalised. During the incident, the complainant was away on business.
The complainant then lodged a police report that led to the arrest of the accused a day after the incident.
The accused admitted to damaging the hut several times before the date of the incident was reported.
It was understood that the hut was built to facilitate the construction of the complainant’s new house and the area was not fenced up.
The prosecution of the case was handled by Insp Merylene Lindan Andrew Mang while the accused was not represented.
