KUCHING: The Magistrate’s Court here fined an elderly man RM1,500 in default three months’ jail for threatening to kill his younger brother over durians.
Alek Dawi, 58, pleaded guilty before Magistrate Mason Jaro Lenya Barayan to the charge under Section 506 of the Penal Code.
The offence happened at a durian farm in Kampung Pesa around 4.30 am on Sept 7, 2023.
According to the case facts, the 56-year-old complainant was waiting for durians to fall in his farm when his brother arrived and began taking the fruits. The complainant informed him that the fruits were for sale.
Feeling dissatisfied, Alek took a machete from a four-wheel drive (4WD) vehicle and then threatened to shoot his brother with a shotgun. He also chased the complainant to a hut and damaged his motorcycle.
Fearing for his safety, the complainant filed a police report, leading to Alek’s arrest on Sept 9.
On Sept 29, 2023, in the same court, Alek was also fined RM1,500 in default three months’ jail for damaging the complainant’s motorcycle, causing a loss of RM800.
For this offence, he was charged under Section 427 of the Penal Code for committing mischief resulting in loss or damage.
Insp Merylene Lindan Andrew Mang prosecuted the case while Alek was unrepresented by a counsel.
