KUCHING: The Magistrate’s Court has sentenced a man to a fine of RM1,500 or three months in jail for damaging his younger brother’s motorcycle, causing RM800 in losses, due to a dispute over durians.
Alek Dawi, 58, from Kampung Pesa, pleaded guilty to a charge under Section 427 of the Penal Code, which was read before Magistrate Mason Jaro Lenya Barayan.
According to the charge, he committed the offence in a durian orchard in Kampung Pesa at around 4.30 am on September 7 this year.
Upon conviction, he could face an imprisonment term of not less than one year and not more than ten years, or a fine, or both.
Based on the facts of the case, while the complainant was waiting for durian fruits to fall and collecting them in his orchard, his elder brother, Alek, suddenly arrived and took some of the fruits.
However, the complainant informed him that the durians were intended for sale.
The accused, dissatisfied with this, retrieved a machete from his four-wheel-drive vehicle and threatened to shoot the complainant with a shotgun.
Furthermore, Alek chased the complainant to a hut and damaged his motorcycle.
Concerned for his safety, the complainant reported the incident to the police for further action, leading to the arrest of the accused on September 9.
Meanwhile, in the same court, Alek pleaded not guilty to a charge under Section 506 of the Penal Code for intentionally uttering threats to kill the same complainant.
Mason allowed the accused to be released on a RM2,000 bond with a local surety and set a date for the next case management hearing on November 7.
The prosecution was handled by Inspector Merylene Lindan Andrew Mang, while the accused was not represented by a counsel.
