KUCHING: The Magistrate’s Court here fined a local man RM1,500 today (Sept 18) or, in default, two months in prison for trespassing into a razed warehouse owned by a sportswear company in January.
Maliki, 35, pleaded guilty before Magistrate Mason Jaro Lenya Barayan to a charge under Section 448 of the Penal Code, which carries a penalty of up to three years in prison, up to RM5,000 fine, or both upon conviction.
He committed the offence at the warehouse at Jalan Simen Raya around 11 am on Jan 26 this year.
According to the case facts, a crime prevention team patrolling the area arrested a man inside the warehouse, which had burnt down and was no longer in use.
During the incident, Mahmud was attempting to take metal from the store.
He was arrested, and a Yamaha motorcycle was seized as evidence.
Investigations revealed that Mahmud admitted to trespassing into the building under the pretext of retrieving some wood.
Insp Merylene Lindan Andrew Mang requested the court to impose an appropriate sentence as a lesson to Mahmud.
