KUCHING: A husband’s action of stealing and selling his wife’s gold necklace resulted in him being sentenced to a fine of RM3,500 in default of five months in prison by the Magistrate’s Court here today.
Mohd Rozly Abdul Latip, 41, pleaded guilty to the charge under Section 414 of the Penal Code, read before Magistrate Syarifah Fatimah Azura Wan Ali.
According to the charge, he was accused of intentionally disposing of stolen property, namely his 40-year-old wife’s gold necklace, at a pawn shop on Jalan Pending around noon on December 14, 2023.
If convicted, he could face imprisonment for up to seven years, a fine, or both.
According to the facts of the case, on January 1, the complainant discovered that her gold bracelet, necklace and ring, stored in a folded cloth were missing, incurring an estimated loss of around RM16,000.
Upon investigation, there were no signs of a break-in, and she suspected her husband (the accused) of the theft due to his previous involvement in similar offences.
Subsequently, the victim filed a police report, leading to the arrest of the accused on January 2.
During the investigation, the accused himself directed the police to the location where he pawned his wife’s gold necklace at a pawn shop on Jalan Pending here.
Furthermore, the pawnshop manager handed over the implicated gold necklace to the police along with the sales receipt bearing the name Mohd Rozly.
The prosecution was conducted by Inspector Ammarsofi Yusoff while the accused was not represented by a counsel.
