SIBU: A 37-year-old man who vented his anger on a cash deposit machine (CDM) and two automated teller machines (ATM) will spend the next three years behind bars reflecting on his bizarre action after he pleaded guilty to a charge of committing mischief.
The Magistrate’s Court here today also fined Jaquclyn RM10,000 in default a year’s jail.
The court was told that Jaquclyn was under the impression that the Bank Simpanan Nasional (BSN) branch at Jalan Kampung Nyabor was at fault when he did not receive a government aid which he wrongly thought he was entitled to.
Jaquclyn, who is from Tanjung Latap, was slapped with the charge for damaging the property of the bank, namely a cash deposit machine (CDM) and two automated teller machines (ATM), causing the bank to suffer losses of RM35,000.
He committed the offence on Jan 15 at 9.30 pm.
The offence is punishable under Section 427 of the Penal Code which provides for an imprisonment term of not less than one year and not more than five years, or a fine or both.
Prosecuting officer DPP Harvind Raja Gopal told the court that on Jan 15 at 9.30 pm the complainant realised that the alarm at the BSN branch in Jalan Kampung Nyabor Sibu went off.
He realised that the screen of the ATM machine and the screen of the CDM machines were damaged and broken and lodged a police report.
The following day, Inspector Hairul led a police party and arrested Jaquclyn at about 11pm at a house in Tanjung Latap,
Subsequently, police seized some equipment and a motorcycle used by the accused in committing the offence.
Police investigations revealed that the bank’s CCTV the accused using a hammer to break the three machines.
Damages to the machines were estimated at RM35,000.
Magistrate Flavian Edward Henry presided over the case.
The accused who was not represented by a legal counsel, failed to pay the fine and will have to serve the default sentence.
