Man gets 5-year jail for drug abuse

KUCHING: A drug abuser has been sentenced to five years in prison and two strokes of the cane by the Sessions Court yesterday for the abuse of methamphetamine and amphetamine earlier this year.

The accused, Zulhaffizan, 29, from Kampung Tupong Ulu, pleaded guilty to one charge before Judge Maris Agan under Section 15(1)(a) of the Dangerous Drugs Act 1952, which is punishable under Section 39C(1)(b) of the same Act.

According to the charge, he has two previous records under Section 15(1)(a) of the Dangerous Drugs Act 1952 in 2021.

He committed the offence at the Narcotics Criminal Investigation Department (NCID) of IPD Kuching, at 1.25 pm on February 27, this year.

Section 15(1)(a) of DDA 1952 provides for a fine of up to RM5,000 or imprisonment for up to two years, or both. Meanwhile, Section 39C(1)(b) of the same Act carries a prison sentence of not less than five years, and not more than seven years, along with up to three strokes of the cane, upon conviction.

Furthermore, the court has ordered Mohammad Zulhaffizan to be under police supervision for two years after completing his prison sentence.

DPP Ruvinasini Pandian prosecuted the case, while the accused was not represented by legal counsel.
