Man gets five years’ jail, caning for drug abuse

SIBU: A 41-year-old man was sentenced to five years’ imprisonment by the Sessions Court here today (Nov 29) for repeatedly abusing drugs.

Judge Marutin Pagan also ordered Ting Ding King from Jalan Lai Chee, to be given one stroke of the cane as penalty.

In addition, the accused were ordered to be placed under police supervision for three years upon his release as well as to report himself to the nearest police station on the first week once in three months.

Ting had earlier pleaded guilty to have administered to himself dangerous drug of ketamine, which is listed in the First Schedule of the Dangerous Drugs Act 1952 without any authorisation.

Since he has had one previous conviction for the same offence, his latest crime was punishable under Section 39(1) of the same Act.

Section 39(1) of the Dangerous Drug Act 1952 provides for a jail term of between five and seven years and liable to whipping of not more than three strokes, upon conviction.

In outlining the facts of case, Deputy Public Prosecutor (DPP) David Bakit Nuing told the court that at about 1.50 am on Oct 28, 2022, a police party led by Insp Wong Ping Tung arrested Ting at Jalan Wawasan on suspicion of involvement in drug abuse activities.

An initial screening test on his urine was conducted using “Rapid Test” found him to be positive for drug. His urine specimen was then sent to Sibu Chemistry Department for analysis.

The investigation outcome revealed that the urine specimen of the accused was found to contain ketamine, an offence under Section 15(1)(a) of Dangerous Drugs Act 1952.

“Based on the registry of criminals, the accused has one previous conviction for a similiar offence,” DPP David further told the court.

Ting who pleaded for leniency was not represented by a counsel.
