Man gets two years for breaching restraining order

KUCHING: A man under police supervision was sentenced to two years imprisonment by the Magistrate’s Court here today (Aug 11) for breaching a restraining order when he failed to report to the police station for a period of two years.

Magistrate Zubaidah Sharkawi meted the sentence on Seli Utau, 48, from Pakan, Sarikei after he pleaded guilty to the charges.

Based on the charges, the accused who underwent a restraining order for two years starting from Oct 17, 2018 until Oct 16, 2020 was found not to have reported himself when he should have reported to the Tabuan Jaya police station every Monday and Thursday.

The accused was charged according to Section 15(4) of the Prevention of Crime Act 1959, which carries a jail term of not more than five years and not less than two years upon conviction.

According to the facts of the case, the complainant, who is a police officer, checked the records of the police surveillance officer (OPP) reporting to the police station and found that the accused had failed to report as stipulated in the restraining order.

On August 6, at around 9.30am, the accused was successfully arrested at the Serian Police Station.

Investigations found that the accused had violated the conditions under the Prevention of Crime Act 1959 for failing to report to the Tabuan Jaya Police Station for two years and it is understood that the accused has several past criminal records.

The prosecution of the case was handled by prosecuting officer ASP Rogayah Rosli while the accused was not represented by a counsel.
