SIBU: A 27-year-old man was sentenced to 12 months’ jail and fined RM3,000 in default three months’ jail by a Magistrates’ Court here today (Aug 2) for an assault charge.
Zaipul Engkabang, from Jalan Hua Kiew understood and the consequences of maintaining his plea of guilty to the charge after it was read and explained to him.
Magistrate Mohd Syukri Mohktar convicted him of the offence as charged under Section 324 of the Penal Code which upon conviction could face up to 10 years’ imprisonment or fine or whipping or with any two of the punishments.
According to the charge sheet, the accused had voluntarily caused hurt to Jackson Sambang Mathew Maging aged 34 by using a dangerous weapon which could cause death at Jalan Khoo Peng Long on July 25 at about 4am.
During the proceedings, the Court was told that on July 25 at about 4am, at Jalan Khoo Peng Long while the complainant was sleeping, the accused went to the scene and hit him with an axe.
Subsequently the complainant was bleeding and fainted at the scene. He later lodged a police report.
Three days later at about 3.05pm, acting on a tip off, a team of police members led by Insp Azuwan from Criminal Investigation Department Sibu arrested the accused.
The outcome of investigation revealed that on July 25 at about 4am, while the complainant was sleeping, the accused approached and told him that he was the one who lodged a police report regarding his (accused) girlfriend offering prostitution service in Sibu.
Argument then ensued between them as the complainant denied the allegation.
The accused became angry and swung an axe towards the complainant who did not manage to dodge and was hit on the neck.
On the same day at about 6.30am, the complainant told his friend about the incident. He was then accompanied by his friend to lodge police report.
Medical report confirmed that the complainant suffered from “Deep laceration wound over left anterior neck and superficial laceration wound over left temporal head” due to sharp weapon.
The accused who was unrepresented by legal counsel, will have to serve a further three months in prison as he could not pay the fine.
