KUCHING: A 39-year-old man was sentenced to nine months in prison by the Magistrate’s Court today for possessing 1.97 grams of methamphetamine last June.
The accused, Hafiz, pleaded guilty to the charge which was read before Magistrate Syarifah Fatimah Azura Wan Ali.
She ordered the accused to serve a prison sentence effective from the date of his arrest on June 19.
According to the charge sheet, he is charged under Section 12(2) of the Dangerous Drugs Act 1952 and can be punished according to Section 12(3) of the same act, for possessing a prohibited substance which is 1.97 grams of methamphetamine.
The accused committed the offence at a house in Tabuan Foo Chow around 4.10pm on June 19.
If convicted, can be punished with imprisonment of up to five years or a fine not exceeding RM100,000 or both.
According to the facts of the case, police arrested the accused at an unnumbered house in Tabuan Foo Chow around 4.10pm on June 19 because he was suspected of being involved in drug abuse activities.
During the investigation, police found a piece of transparent straw containing crystals suspected to be methamphetamine with a rough weight of 2.44 grams in a sling bag belonging to the accused.
Based on the chemical report that has been sent to the Malaysia Chemical Department, they confirmed that the case item is a methamphetamine drug weighing 1.97 grams which is a type of drug in the First Schedule of the Dangerous Drugs Act 1952.
In another case in the same court, a 26-year-old man was sentenced to a fine of RM5,000 or 12 months in prison for possessing 3.59 grams of methamphetamine.
He was accused of possessing the prohibited substance at the foot of the stairs of a premises in Kota Sentosa at about 3pm on June 22.
During the inspection on the accused, police found the drugs in the accused’s duffel bag.
It is understood that the accused was reportedly unable to pay the fine involved.
The prosecution for both cases was handled by Prosecuting Officer Inspector Mohd Adzmei Ahmad while the two accused were not represented by lawyers.
