KUCHING: Two employers were found guilty of not complying with the Minimum Wages Order (Amendment) 2018 during an operation conducted here yesterday.

Twenty others were found to be in breach of the provisions under the Sarawak Labour Ordinance (SLO).

The operation was conducted by the Sarawak Labour Department (SLD) in collaboration with the Social Security Organisation (Socso) and the Employees Provident Fund (EPF).

The offences included 14 cases of failure to prepare and keep their workers’ employment terms and conditions record, failure to prepare and keep workers’ particulars (13 cases), failure to prepare and keep salaries and allowances record (12 cases), failure to give notice under Section 60A of the SLO (seven cases) and payment of salary through bank or by cheque without the workers’ written consent (six cases).

Others are failure to pay workers’ salary during public holidays (five cases) and failure to give salary slips (four cases).

According to SLD, the enforcement team had conducted the joint operations on 27 work premises.

Investigation papers would be open for all the offences under the National Wages Consultative Council Act.

SLD said the joint operation would be continued until August to ensure strict compliance of the minimum wages and other labour laws that were being enforced by all three agencies involved.

The Minimum Wages Order (Amendment) 2019 came into effect on Jan 1 this year, providing for a minimum wage set at RM1,100 per month or at RM5.29 per hour for those workers paid at an hourly rate.
