No money to pay fine, accused opts for jail

SIBU: A 33-year-old man has to spend the next seven months in jail after he could not pay the RM5,000 fine meted out by the Magistrate’s Court here today for assaulting his nephew with a piece of wood.

Mohd Nazaree Selihi from Jalan Abang Barieng pleaded guilty to the charge before magistrate Mohd Syukri Mokhtar.

The accused was charged with voluntarily caused hurt to Muhammad Abdul Rahman, 24, at with a weapon that could cause death on Nov 13 last year.

He was convicted under Section 324 of the Penal Code, and could have faced up to 10 years’ jail or fined or whipped or any two of the punishments.

The accused couldn’t pay the RM5,000 fine and had to spend seven months behind bars in default.

Prosecuting officer Inspector Badrul Iskandar Selamat told the court that on Nov 13 last year at about 5pm the victim was riding a motorcycle at Kampung Nangka Road, when he was suddenly stopped by his uncle and assaulted with a wooden stick.

The victim suspected his uncle assaulted him because of the grudges he bore on his family.

As a result of the incident, the victim sustained head injuries and had to receive treatment at the Sibu hospital where he received six stitches.

On Feb 13 this year, a team of police led by ASP Jarraw Madong arrested the accused at Jalan Abang Barieng.
