KUCHING: A teenage boy was ordered to do 200 hours of community service by the Sessions Court today for robbing a man at a 24-hour convenience store in Jalan Sentah Segu, last June.
Judge Jason Juga sentenced the 18-year-old accused after hearing the social report submitted by the Social Welfare Department as well as submissions from the prosecution and defence.
On June 24, before Judge Dayang Ellyn Narisa Abang Ahmad, the accused pleaded guilty to charges under Section 392 of the Penal Code.
If convicted, can be sentenced to prison for up to 14 years and can be fined or caned.
Therefore, the court set the social report hearing and then sentencing today.
According to the charges, he is accused of robbing a sum of cash, a silicone baby nipple, a lighter, and a one litre box of drinking water.
He committed the act against a 25-year-old worker at a 24-hour convenience store in Jalan Sentah Segu, Siburan, at about 3.40am, on June 1.
It is understood that the accused is a student at a private skills training institution who was under the influence of alcohol and sane when the incident occurred.
Earlier, the Social Welfare Department (JKM) suggested that the accused be fined at a rate that his family can afford.
However, Deputy Public Prosecutor Nurfadzlin Mahmad Zulhasnan told the court that the fine was not appropriate for the gravity of the offense committed by the accused.
Therefore, the prosecutor requested that the court impose a sentence commensurate with the seriousness of the offense committed by the young offender.
The matter involved was also agreed by the lawyer Abdul Rahman Mohd Hazmi who represented the accused.
Abdul Rahman stated that the fine was not appropriate because the accused’s parents would pay the fine.
Hence, the court ordered the accused to be sentenced to a Community Service Order with an aggregate amount of 200 hours based on Section 293(1)(e) of the Criminal Procedure Code with a time and place determined by the welfare office.
