KUCHING: The Session’s Court here ordered a teenager to be sent to the Henry Gurney School in Puncak Borneo for raping his underage girlfriend.
The accused, 18, pleaded guilty before Session’s Court judge Jason Juga for raping his girlfriend until she gave birth to a baby girl.
Jason ordered the accused, who is unemployed, to be sent to the school until he reached the age of 21.
The accused was charged under Section 376 (1) of the Penal Code which provides for a jail term not exceeding 20 years and whipping.
Investigations found that the accused and the victim had sexual intercourse in a rented house at Jalan Sungai Maong Hilir on June 2019. At that time, the victim was 15 years old while the accused was 17 years old.
The victim was then taken by her father to a government clinic on March 2, 2020 for treatment and results showed that the victim was pregnant.
Following that, a police report was lodged by a female doctor from the clinic and the accused was arrested the next day (March 3, 2020).
Laboratory results found that DNA tests revealed that the baby was the child of the accused and the victim.
The case was handled by Deputy Public Prosecutor Nurfadzlin Mahmad Zulhasnan while the accused was not represented.
