KUCHING: A 15-year old teenager was ordered by the Magistrates’ Court to be sent to Sekolah Tunas Bakti for three years after he pleaded guilty to stealing a motorcycle belonging to a 55-year-old woman.
Magistrate Zubaidah Sharkawi sentenced the teenager to a charge in accordance with Section 9(1)(f) Child Act 2001 after reviewing the Welfare Department’s (JKM) report.
The Magistrates’ court had ordered for the teenager to be placed under the supervision of JKM personnel for a year after he is released from the school.
Based on the facts of the case, the teenager committed the offence at a house in Jalan Laruh around 5 pm on Dec 5, 2022.
If convicted, the accused charged under Section 411 of the Penal Code, is liable for a punishment of jail term of up to five years or a fine.
According to the facts of the case, the complainant realised the bike had gone missing around 7.10 am. Earlier it was parked at her house in Jalan Ajibah Abol.
The complainant lodged a police report on the missing motorcycle, which was an estimated RM9,800 loss.
Based on the information given, a police force went to a house in Jalan Laruh around 5 pm on Dec 5, 2022 to arrest the teenager (the accused).
The accused himself showed the police the motorcycle, which he had kept inside his house.
The chassis number of the motorcycle revealed it was the complainant’s lost motorcycle.
Further investigations revealed that the accused had stolen a Yamaha motorcycle which belonged to a woman named Norwani.
The prosecutor of the case was Insp Nur Syafiqa Nyaie Ilin while the young offender was not represented by a legal counsel.
