SIBU: A 58-year-old man was today fined RM1,000 in default one month’s jail by a Magistrate’s Court here for trading in second-hand goods without any licence.
Magistrate Mohd Syukri Mokhtar imposed the fine on Wong from Jalan Rambutan after he understood and pleaded no contest to the charge against him.
According to the charge sheet, the accused was found to have dealt with second-hand goods without any licence at a premises in Jalan Rambutan at about 3.40pm on August 2.
The offence is listed under Section 6 of Second-hand Dealers Act 1946 and punishable under Section 9 of the same Act which upon conviction is liable to a fine not exceeding RM1,000 or to imprisonment term which may extend to three months or both.
During the proceedings, Deputy Public Prosecutor (DPP) Harvind Raja Gopal told the court that on August 2 at about 3.40pm, a police team led by Insp Md Azuwan Mohamad made an inspection on a premises in Jalan Rambutan.
The inspection was conducted in the presence of the owner of the premises who was later identified as the accused person.
Outcome of the inspection revealed that the accused had been dealing with second-hand goods without any licence under the Second-hand Dealers Act 1946.
Subsequently, various items were seized including three sacks of copper, three sacks of aluminium tin, six units of engine component, two units of motorcycle rim, one sack of aluminium, a unit of weighing scale as well as cash amounting to RM1,239.
The accused was then detained and brought to the police station for further investigation.
DPP Harvind told the court that investigation revealed that the accused did not have a licence to deal with second-hand goods.
“The Licensing officer confirmed that the accused did not have a licence to trade in second-hand goods under the Second-hand Dealers Act 1946,” he further told the Court.
Wong, who was unrepresented by legal counsel, opted to pay the fine.
