Two men get prison time for house-breaking and theft

SIBU: Two men were each sentenced to one year’s imprisonment on Tuesday (June 18) by the Magistrates’ Court here for jointly committing house-breaking and theft.

Zulkarnain Rosman, 28, from Jalan Tiong Hua and Nicholas Raju, 32, from Jalan Hardin pleaded guilty to the joint charge read and explained to them through an interpreter.

Magistrate Oon Kork Chern convicted them of the offence as charged under Section 457 of the Penal Code, which provides for a jail term of not less than one year and not more than 14 years as well as liable to whipping and fine, upon conviction.

He deferred sentencing on another juvenile whose name was withheld, who was indicted together with the two accused, pending probation report against him on Aug 1.

The charge against the trio stated that they had jointly between June 9 at about 5pm and June 10 at about 5.30pm, at a restaurant along Jalan Lebuh Tanahmas, committed house-breaking with the intention to commit theft of property.

In outlining the fact of case, prosecuting officer Inspector Kumreswaran Murugan told the court that on June 10 at about 5.30am, the restaurant proprietress (complainant) found the roller shutter door of the restaurant open.

She believed that it was broken into, and when she made an inspection inside the shop, she found that various items were missing, including coins amounting to RM100, 20 different types of canned soft drinks, 2kg of meat, 2.5 kg of stingray, three tissue packs and three packets of 3-in-1 Nescafe coffee.

She estimated her loss at approximately RM300, and subsequently lodged a police report for further action.

On June 12, at about 2.10am, acting on information received, a police team arrested the three accused at a house in Jalan Bukit Assek.
