KUCHING: The Magistrates’ Court here sentenced two men each to six months in prison for possessing a stolen motorcycle belonging to a 54-year-old woman.
Zaini Meliki, 39, and Amirul, 29, pleaded guilty to the charges framed under Section 411 of the Penal Code, read together with Section 34 of the same Code, which provides for a jail term of up to five years, or a fine, or both, upon conviction.
Magistrate Zubaidah Sharkawi ordered both men to serve their sentences effective today (March 20).
They committed the offence of retaining a stolen Sport Bonus SR motorcycle belonging to a woman at the Sama Jaya Free Industrial Zone around 1.30am on March 14.
According to the case facts, a man lodged a police report that his mother’s motorcycle, which was parked in front of a pharmacy in MJC Batu Kawa, was missing and suspected to be stolen around 11am on March 11.
Following the report, the police managed to arrest Zaini and Amirul on March 14 in a crime prevention patrol. In addition, the motorcycle used by the men was seized.
Investigations found that both men were in possession of stolen property, namely a motorcycle that belonged to the victim, based on its chassis number.
Insp Nur Shafiqa Nyaie Ilin, who prosecuted the case, requested that both men be sentenced accordingly as a lesson.
Meanwhile, in the same courtroom, Zaini was fined RM3,000, in default three months in prison, for abusing amphetamine and methamphetamine.
He was charged under Section 15(1)(A) of the Dangerous Drugs Act 1952, punishable under Section 15 (1) of the same Act.
Upon conviction, it carries a jail sentence of up to two years, or a fine up to RM5,000, and immediate supervision for a term of up to three years.
