Woman fined RM5k for contravening Trade Description Act

SIBU: A woman was fined RM5,000, in default three months’ imprisonment, by the Sessions Court here for violating the Trade Description (Optical Disc Label) Act 2010.

Sessions Court judge Marutin Pagan meted out the sentence against Wong Lee Chin, 43, from Lorong Old Oya.

According to the charge, she had in the course of business, offered to supply 1,400 pieces of optical disc in DVD format without optical disc labels at a shop unit in a shopping mall in Ulu Oya on March 7 last year at about 10.53am.

Thereby, she had committed an offence under subparagraph 4(4)(a) of the Trade Description (Optical Disc Label) Act 2010.

Under the Act , it states that any person, other than a corporate body, who commits the offence, on conviction, be liable to a fine not exceeding RM10,000 or to imprisonment for a term not exceeding one year or both, and for a second or subsequent offence, to a fine not exceeding RM20,000 or imprisonment of not more than three years or both.

During the proceedings, the court was told that on March 7, 2022, at about 10.53am, a team of enforcement officers from the Ministry of Domestic Trade and Consumer Affairs conducted an inspection at the shop unit.

As a a resut, a total of 1,400 pieces of optical disc in the form of DVD displayed for sale without optical disc labels were seized for further action.

A police report was subsequently made regarding the matter. The accused paid the fine.
